1. Acceptance of these terms
These Terms & Conditions ("Terms") govern your access to and use of the EverStonepoint website and its content ("the Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
2. About the service
EverStonepoint is an independent Australian travel publisher. We share route guides, free-camp listings, 4WD touring notes, caravan gear advice and camp-kitchen content for travellers planning trips around Australia. The Service is provided for general information and inspiration only.
3. Travel information is general guidance only
Our content is general guidance, not professional, safety, legal, mechanical or navigational advice. Conditions on the road change constantly, and information that was accurate when published may be out of date by the time you travel.
You must verify conditions yourself before you travel. Always confirm current road and track status, weather, fire and flood warnings, fuel availability, water sources, opening times, fees, vehicle requirements, and any permits, closures or access restrictions with the relevant land manager, park authority, council, police or official road-information service. Never rely on our route, camp or track notes as your sole source of information.
4. Reliance on route, camp and track information
To the maximum extent permitted by law, we accept no liability for any loss, damage, injury, cost or inconvenience arising from your reliance on route descriptions, free-camp listings, 4WD track notes, distances, maps, gear recommendations or any other information on the Service.
Touring remote parts of Australia carries real risks. You are responsible for your own safety, the suitability and roadworthiness of your vehicle and equipment, your driving and navigation decisions, and for carrying adequate supplies, communications and recovery gear. Travel within your ability and the limits of your set-up.
5. Intellectual property
Unless otherwise stated, all content on the Service — including text, photographs, illustrations, maps, logos and the site design — is owned by EverStonepoint or its licensors and is protected by Australian and international copyright laws.
You may view and print content for your own personal, non-commercial trip-planning use. You must not reproduce, republish, sell or distribute our content, or use it to train automated systems, without our prior written permission.
6. Your submissions
If you submit content to us — such as camp notes, route feedback, photos or comments — you confirm that it is your own, that it is accurate to the best of your knowledge, and that it does not infringe anyone else's rights.
By submitting content, you grant EverStonepoint a non-exclusive, royalty-free, worldwide licence to use, reproduce, edit and publish that content in connection with the Service. You retain ownership of your content, and we may remove any submission at our discretion.
7. Third-party links
The Service may contain links to third-party websites, products or services that we do not control. We provide these links for convenience only and are not responsible for the content, accuracy, availability or practices of any third-party site. Following a link is at your own risk, and any dealings you have with a third party are between you and that party.
8. Acceptable use
When using the Service, you agree not to:
- use it for any unlawful, fraudulent or harmful purpose;
- post content that is false, misleading, offensive, defamatory or that infringes others' rights;
- attempt to gain unauthorised access to, disrupt or damage the Service or its infrastructure;
- scrape, harvest or bulk-extract content using automated means without our permission; or
- misrepresent your identity or impersonate any person or organisation.
9. Disclaimers and limitation of liability
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we exclude all warranties, express or implied, including as to accuracy, completeness, reliability or fitness for a particular purpose.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, our liability is limited to re-supplying the relevant content or the cost of doing so.
Subject to the above, to the maximum extent permitted by law we are not liable for any indirect, incidental, special or consequential loss, or any loss of profits, data or goodwill, arising from your use of, or inability to use, the Service.
10. Governing law
These Terms are governed by the laws of the State of Victoria, Australia. You and EverStonepoint submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia in relation to any dispute arising from these Terms or your use of the Service.
11. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Service after any change means you accept the updated Terms.
